Federal Tax Return Offsets

Rep. Nancy Pelosi

February 14, 2013

I am a single mom of 2 boys (11 and 13). We have spent most of the last 2 years homeless. We were staying at friends' homes on the couch and floor in Rio Rancho, NM. I was employed in Albuquerque and had to beg people for a ride to the main bus depot, just to catch the bus into the city to get to work. The same hardships fell for the return trip home, daily. When NM showed it had no potential for improvement for our family, we returned home to CA. I finally started making headway with my Dr.s, who have placed me on 22 hours/day bed-rest. I have several debilitating issues that are in need of attention. I have filed for disability in Dec. 2012, but they said it will take 6 months for approval/denial. In the mean time, I was waiting as patiently as possible for my tax return. When it was approved, it came with a link stating that Congress will garnish those monies for a school loan. A school loan has precedence over homelessness and disabilities? Those monies hold our family's safety and well-being in them. We just moved into a place where my boys and I share a 10x10 room. The landlord delayed payment of the deposit until the tax return was received. But apparently, The Department of Education has the right to garnish ALL of it, without leaving anything for our family to survive on. We are going to end up losing the one roof we have fought through so much to have. There MUST be something that can stop this. It's holding our lively-hood for ransom. Only Congress can ammend this for a family who clearly falls under any 'Hardships' category. PLEASE HELP US!
