This entire thing is a fraud. The real issue as I see it is how do doctors, hospitals, technicians, etc. get paid? The fresh, new doctor straight out of med school pays less in malpractice insurance than a physician with twenty years experience. Why? Because the longer practicing doctor has a longer liability history than the newby. The malpractice premium should be based on history of care, with those who are careless paying more, just as in auto insurance. And those who practice continually bad medicine should be barred from practice. If tort reform is not addressed then this whole thing is a flipping joke.
