The Vice President just committed and illegal and UN Constitutional act and having done so can be impeached and removed from office. The US Constitution strictly prohibits Ex Post Facto Laws, meaning a law passed that is retroactive, which is this case in Massachusetts legislature has just done the Law prohibiting the governor in appointing a temporary senator was in affect when Senator Kennedy died having been passed in 2004. The 17th Amendment also states that only if the Legislature has authorized the State Executive to do this is it allowed, otherwise there must be a special election. The Illinois Governor is also guilty of violating the !7th amendment as he has not placed a warrant for a special election to fill the vacancy left by Senator Obama.

When vacancies happen in the representation of any state in the Senate, the executive authority of such state shall issue writs of election to fill such vacancies: Provided, that the legislature of any state may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct.
This amendment shall not be so construed as to affect the election or term of any Senator chosen before it becomes valid as part of the Constitution. "
"Former Democratic Party chairman Paul G. Kirk Jr. has taken over for the late Edward Kennedy in the Senate.
Vice President Joe Biden swore in Kirk on Friday hours after a Massachusetts judge rejected a Republican request to delay it.
The GOP had argued that Democratic Gov. Deval Patrick exceeded his constitutional authority by appointing Kirk before a traditional 90-day legislative waiting period had expired. State lawmakers passed a bill this week giving Patrick the power to choose an interim senator.
Kirk gives Senate Democrats a filibuster-proof, 60-vote majority with the health care fight at a critical point.
He will serve in the interim post until voters pick a replacement in a Jan. 19 special election."
