Health care bill

Dear Representative LaTourette;
In reading a post by Michael Connelly of Carrollton, Texas (http://michaelconnelly.viviti.com)... Constitutional lawyer and has read the entire health care bill and has some comments, not about the bill, but about the effects on our Constitution I have come to the conclusion that for any member of congress to vote for this bill is a complete breech of his/her oath of office. Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation" to support this Constitution. It's a broader picture than just health care reform.
It's time we, that is the members of Congress and the citizens of the United States, sit up and pay attention; once this sort of thing happens, it will be irreversible. If you believe that your position as a member of congress insulates you from the effects of this bill, you are mistaken. We (the people) have every reason to be very afraid of what is happening.
To begin with, much of what has been said about the law and its implications is in fact true, the law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved. Just read the bill.
Private insurance companies will be forced out of business and everyone will be forced into a government run system. Every socialist country in the world has failed at government run health care. All medical transactions will be strictly controlled
This bill is a convenient cover for one of the most ambitious transfers of power to the Executive Branch of the government and it is not about Health care. It is about power and control. If this bill or a similar one is passed it will destroy major portions of the Constitution. The Constitution that you have sworn (affirmed) to uphold.
The balance of power between the three branches of government will disappear and the fact is that Congress has no authority in any of the areas expressed in the bill.
Appointees of the Obama administration (not screened by congress) will be given unlimited access to private information including but not limited to personal health care, financial information, employment information, and information from your private physician and hospital. This is in direct violation of the 4th Amendment of the Constitution protecting against unreasonable searches and seizures.
In case you haven't read it lately "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause,
supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
How about the "tax" if you decide not to have healthcare or private insurance? Then the Obama plan provides for a "Health Choices Administrator" appointed by Obama to impose a tax on you, and nothing in the law allows you to contest the tax. This is definitely the depriving of a person of property without the "due process of law."
The ninth amendment of the Constitution states "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people."
The tenth amendment of the Constitution states "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." Under the rules of this "bill" neither the people nor the states will have any rights.
I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care I have read it and cannot find any reference to health care. Please do not use the "promote the general welfare" as a crutch to pass this bill.
You, as a member of Congress, are held responsible for Article 6 of the Constitution, ". . . The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution;. . . "The Constitution that you have sworn (affirmed) to uphold.
I do not claim to be a Constitutional Scholar, nor do I claim to be a "Legal expert". I do claim to be of average intelligence and am capable of reading. Any vote, other then "NO" will be a breech of your oath of office. I believe that if you vote for this bill the American people will hold you accountable.
